TEAM organised a legal session at the International Business Forum in Kazan

On November 14, TEAM participated in the organization of an international event. The TEAM Consulting Group organized and conducted a session: "International Commercial Arbitration. Resolution of cross-border disputes and mutual enforcement of court decisions in China and Russia" at the International Forum "ROSTKI: Russia and China — mutually beneficial cooperation."

The speakers were:

  • Anna Chepurnaya, a leading lawyer at TEAM’s Moscow office, who presented on "Cross-Border Disputes Resolution: Pros and Cons of International Arbitration";
  • Sabina Ganieva, executive administrator of the Russian Arbitration Center, who spoke on "Arbitration Agreements and Enforcement of Decisions in Modern Reality: Practical Cases and Recommendations from the Arbitration Institution";
  • Chen Zhigang, Chairman of the Russian-Chinese Business Center, General Director of the Russian-Chinese Business Park, and Chairman of the Chinese Society in St. Petersburg, who discussed "Mediation and negotiation as alternative methods for resolving cross-border disputes between Russia and China";
  • Stone B. Go, partner at the Shanghai office of Yingke Law Firm and Director of the International Capital Markets Department, who presented on "Enforcement of Arbitration awards in China";
  • Alexander Zainigabdinov, Partner at China Window Consulting Group, Head of the Beijing office, Advisor to the Chamber of Commerce and Industry of the Russian Federation, representative of OPORA Russia in Beijing and Arbitrator at the Shanghai International Arbitration Center, who spoke on "Methods for resolving Russian-Chinese economic disputes: practice and a bit of theory";
  • Natalia Sukhova, General Director and Managing Partner of SinoFai Legal LLC, who presented on "Practice and issues of recognizing arbitral awards in China."

Comments on the discussed issues were provided by:

  • Maria Krivenkova, Head of the Legal and Documentation Support Department at the Investment Development Agency of the Republic of Tatarstan;
  • Shamil Ageev, Chairman of the Union of "Chamber of Commerce and Industry of the Republic of Tatarstan," Doctor of Economics, Professor.
The session was moderated by Viktor Mironov, Managing Director of TEAM.

Arbitration as a method of resolving cross-border disputes is gaining popularity, including in Russia and China. Due to confidentiality, procedural flexibility, the ability to select specialists as arbitrators in specific fields, and other advantages, arbitration is increasingly used by Russian and Chinese enterprises.

Parties involved in arbitration disputes are becoming more confident in arbitration, notably due to the positive statistics on the enforcement of arbitral awards. Given the rising state fees for resolving disputes in state courts, arbitration also appears to be economically effective.

As Shamil Ageev, Chairman of the Chamber of Commerce and Industry of the Republic of Tatarstan, noted in his speech, the President of the Russian Federation instructed Russian businessmen involved in foreign economic activities to include arbitration clauses in contracts

Thus, the results of the session indicate a very positive conclusion that arbitration as a method of alternative dispute resolution has already gained strong position among the Russian-Chinese business community and will continue to develop and strengthen.

Following the session, the TEAM Consulting Group signed a cooperation agreement with the Association for the Promotion of Business Relations "Chinese Business Center" in a ceremonial setting.

TEAM’s lawyers provide consulting services to businesses on issues related to arbitration disputes involving foreign economic contracts, including those with Chinese counterparts, and the enforcement of arbitral awards in China and Russia. They also act as intermediaries in negotiations involving Chinese lawyers.
